Privacy Policy
Personal Data refers to all information that is associated with a specific individual and can be used to reasonably identify that individual. Non-Personal Data, on the other hand, refers to all information that does not constitute Personal Data (including but not limited to any analytical data). Non-Personal Data also includes information we receive in an anonymous or pseudonymous form, such that it cannot be attributed to any natural person.
2. Anonymity Principle
When you use the KM websites, you will remain anonymous to us as long as you do not actively provide us with Personal Data, such as registering an account, placing an order with KM online or by telephone, subscribing to emails or newsletters, directly requesting information from or communicating with us, sending us a message via the contact form, or applying for a position with us. However, the use of our websites may result in the provision of certain Non-Personal Data, as detailed in Section 4.
3. How We Collect and Use Information
We collect your Personal Data to provide you with a personalized, useful, and efficient experience. The categories of information we may collect include:
Information You Provide to Us
When you create an account, place an order, or communicate with us, we collect the information you provide. For example, when you register an account or purchase our products, we may ask you to provide Personal Data (such as your name, mailing address, email address, telephone number) or relevant business information. We may also collect the content of any communications between you and us, as well as any information you provide when participating in interactive service features (such as promotions, surveys, etc.). Information We Obtain from Social Media Websites
When you interact with our services through various social media platforms, such as logging in via Facebook, or sharing company content on Facebook, Twitter, Pinterest, Instagram, or other websites, we may receive information from the social networks, including your profile information, profile picture, gender, username, user ID associated with your social media account, age range, language, country/region, friend list, and any other information you allow the social networks to share with third parties. The data we receive depends on your privacy settings on the social networks. Before linking or connecting third-party websites and services to our websites or services, you should always review and adjust your privacy settings on those websites and services as necessary.
Information from Other Sources
We may obtain Personal Data from other sources (such as third-party information providers) or through mergers and acquisitions, and merge it with previously collected information. In such cases, this Privacy Policy will govern the processing of the merged Personal Data.
We use this information to operate, maintain, improve, and provide you with the features of our services, as well as to communicate directly with you, such as sending you emails about products and services that may be of interest to you. We may also send you service-related emails or messages (e.g., account verification, purchase confirmations, changes or updates to service features, technical and security notifications). Similarly, if you request information from us via the online contact form or contact us by email, we collect the information you provide (e.g., name, telephone number, email address) to enable us to respond to you.
4. Collecting Information Using Cookies and Other Tracking Technologies
When you visit our websites, read our emails, or otherwise interact with us or our services, we collect certain types of usage information. We typically collect such information through various tracking technologies, including cookies, web beacons, log files, and similar technologies (collectively, "Tracking Technologies"). For example, we collect information about your device and its software, such as your IP address, browser type, internet service provider, platform type, device type, operating system, date and time stamps, unique identifiers that uniquely identify your browser, mobile device, or account, and other such information. We may also collect information about how you use our websites or services, such as the pages you visit, the links you click, the frequency of your visits to the websites or services, whether you open emails or click links in emails, whether you access the websites or services from multiple devices, and other actions you take on our websites or services. When you access our services via a mobile device, we may collect unique identifiers associated with your device or our mobile applications (e.g., UDID, Advertising Identifier (IDFA), Google AdID, or Windows Advertising ID), mobile carrier, device type, model, and manufacturer, mobile device operating system brand and model, telephone number, and, depending on your mobile device settings, your geolocation data, including GPS coordinates (e.g., latitude and/or longitude) or similar information related to the location of your mobile device; alternatively, we may determine the device's location approximately by analyzing other information (such as IP address). We may collect analytical data or use third-party analytical tools to help us measure traffic and usage trends of our services and better understand the statistical information of our users. We may also cooperate with third-party partners to adopt technologies, including application statistical modeling tools, to attempt to identify you across multiple devices. Although we make every effort to respect users' privacy preferences, we currently cannot respond to "Do Not Track" signals from browsers.
In addition, we use cookies to help track items you add to your shopping cart, including when you abandon your cart. This information is used to determine when to send cart reminder messages via our SMS service.
We use or may use the data collected through Tracking Technologies to: (a) remember information so that you do not have to re-enter it during your visit or on your next visit to the websites; (b) provide customized, personalized content and information, including targeted content and advertisements; (c) identify you across multiple devices; (d) provide and monitor the effectiveness of our services; (e) monitor aggregate metrics on our websites, such as total number of visitors, traffic, usage, and demographic patterns; (f) diagnose or fix technical issues; and (g) otherwise plan and improve our services.
If you do not wish to accept cookies, most browsers allow you to: (i) change your browser settings to notify you when cookies are received, allowing you to choose whether to accept them; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies. Please note that doing so may negatively impact your experience using the websites, as certain features and services on our websites may not function properly. Depending on your mobile device and operating system, you may not be able to delete or block all cookies. You can also set your email preferences to prevent the automatic downloading of images that may contain technologies that help us understand if you have accessed our emails and performed certain actions.
We may also use cookies and tracking technologies for advertising purposes.
KM uses cookies to collect information about abandoned shopping carts. A shopping cart is considered abandoned after being idle for one hour. Once a shopping cart is deemed abandoned, the system will send an SMS reminder.
5. When We Share Personal Information
Komilight will not sell, transfer, lend, or otherwise disclose any customer information to third parties. Similarly, your Personal Data will not be transferred, sold, or otherwise disclosed to third parties. Any contrary action will only be permitted if it is necessary to achieve the notified or agreed purpose and complies with the applicable data protection laws. We use information to fulfill orders and improve your experience when interacting with us. For example:
KM Partners
We share Personal Data necessary to fulfill orders with our Partners. The shared data is limited to the minimum information required to complete the order (name, mailing address, relevant contact information, ordered product details).
IT Service Providers
We have entered into contracts with several service providers to assist us in providing, operating, and maintaining our IT systems, including the KM websites. These service providers include hardware and software vendors, Google Inc. (which provides web analytics services Google Analytics), hosting service providers, or data centers, etc. When these service providers work for us, they may access your Personal Data as data recipients. However, these service providers are obligated to comply with applicable data protection laws pursuant to the contract.
Other Third Parties
We may share or disclose your Personal Data if we, in our sole judgment, believe that we are required to do so under applicable laws or regulatory requirements, or if we reasonably believe that disclosure is necessary to prevent harm or economic loss, or is related to the prevention of fraud or illegal activities, and/or to enforce our terms and conditions.
Parties to a Business Transaction
We reserve the right to transfer any information we collect in the event of a sale or transfer of all or part of our business or assets (including company shares) or any part or combination of products, services, businesses, and/or assets. In the event of such a transaction (whether an asset sale, merger, acquisition, bankruptcy, dissolution, restructuring, liquidation, or similar transaction or proceeding), we will use reasonable efforts to ensure that any transferred information is processed in accordance with this Privacy Policy.
6. Your Control Over Your Information
Email Communications
Regardless of whether you have previously sent an email to KM, you agree that KM may send you emails and other electronic communications for (a) matters related to your use of our websites, (b) daily business transactions, or (c) any other legitimate business purposes (including but not limited to KM's newsletters and other marketing materials). If you wish to unsubscribe from such emails, simply click the "Unsubscribe" link provided at the bottom of the email. Please note that you cannot unsubscribe from certain service-related emails (e.g., account verification, transaction confirmations, technical or legal notifications).
Modifying Account Information
If you have an online account with us, you can modify certain information in your account (such as your contact information) through the "Profile", "Account", "Settings", or "Preferences" options on the website. If you have any questions about modifying or updating any information in your account, please contact us via the email address, telephone number, or mailing address provided below.
Deleting Personal Data
You may object to our use of your Personal Data at any time by contacting us at support@komilight.com.
7. Data Protection and Security
Data Retention
After the termination or deactivation of your user account, KM may retain your data for a reasonable business period for record-keeping, auditing, or other purposes. Any Personal Data that we can access will be retained, stored, and deleted in accordance with our agreements with business partners and service providers.
Data Storage and Transmission
Your information will be stored and processed in the United States. If you are located in the European Union or other regions where data collection and use laws may differ from those in the United States, please note that we will take all reasonable and necessary measures to ensure that all Personal Data is processed securely and in compliance with this Privacy Policy.
Protecting Information Security
KM attaches great importance to the security of your information and has adopted commercially reasonable physical, technical, and organizational measures designed to maintain the integrity and security of all information we collect. However, no security system is absolutely secure, and we cannot guarantee 100% the security of our systems. If any information under our control is disclosed due to a security breach, we will take reasonable measures to investigate the situation and, if appropriate, notify the individuals whose information may have been disclosed in accordance with applicable laws and regulations, and take other actions.
8. Your Rights
We will respond within the time limit specified by applicable law. Please note that many of the above rights are subject to exceptions and limitations. Certain services can only be provided if we have your information, and therefore, deleting your information will result in the termination of such services.
