Komilight (referred to as "KM", "the Company", or "we") conducts its business with a commitment to protecting your privacy. This Privacy Policy explains how we collect, use, and share personal information obtained from visitors to our websites (including www.komilight.com, its subdomains, related domains, and all other websites posting this Privacy Policy). Non-Personal Data, on the other hand, refers to all information that does not constitute Personal Data (including but not limited to any analytical data). Non-Personal Data also includes information we receive in an anonymous or pseudonymous form, such that it cannot be attributed to any natural person.

2. Anonymity Principle

When you use the KM websites, you will remain anonymous to us as long as you do not actively provide us with Personal Data, such as registering an account, placing an order with KM online or by telephone, subscribing to emails or newsletters, directly requesting information from or communicating with us, sending us a message via the contact form, or applying for a position with us. However, the use of our websites may result in the provision of certain Non-Personal Data, as detailed in Section 4.

Information You Provide to Us

Information from Other Sources

We may obtain Personal Data from other sources (such as third-party information providers) or through mergers and acquisitions, and merge it with previously collected information. In such cases, this Privacy Policy will govern the processing of the merged Personal Data.

We use this information to operate, maintain, improve, and provide you with the features of our services, as well as to communicate directly with you, such as sending you emails about products and services that may be of interest to you. We may also send you service-related emails or messages (e.g., account verification, purchase confirmations, changes or updates to service features, technical and security notifications). Similarly, if you request information from us via the online contact form or contact us by email, we collect the information you provide (e.g., name, telephone number, email address) to enable us to respond to you.

4. Collecting Information Using Cookies and Other Tracking Technologies

When you visit our websites, read our emails, or otherwise interact with us or our services, we collect certain types of usage information. We typically collect such information through various tracking technologies, including cookies, web beacons, log files, and similar technologies (collectively, "Tracking Technologies"). Although we make every effort to respect users' privacy preferences, we currently cannot respond to "Do Not Track" signals from browsers.

In addition, we use cookies to help track items you add to your shopping cart, including when you abandon your cart. This information is used to determine when to send cart reminder messages via our SMS service.

We use or may use the data collected through Tracking Technologies to: (a) remember information so that you do not have to re-enter it during your visit or on your next visit to the websites; (b) provide customized, personalized content and information, including targeted content and advertisements; (c) identify you across multiple devices; (d) provide and monitor the effectiveness of our services; (e) monitor aggregate metrics on our websites, such as total number of visitors, traffic, usage, and demographic patterns; (f) diagnose or fix technical issues; and (g) otherwise plan and improve our services.

KM uses cookies to collect information about abandoned shopping carts. A shopping cart is considered abandoned after being idle for one hour. Once a shopping cart is deemed abandoned, the system will send an SMS reminder.

5. When We Share Personal Information

Komilight will not sell, transfer, lend, or otherwise disclose any customer information to third parties. Similarly, your Personal Data will not be transferred, sold, or otherwise disclosed to third parties. Any contrary action will only be permitted if it is necessary to achieve the notified or agreed purpose and complies with the applicable data protection laws. We use information to fulfill orders and improve your experience when interacting with us. For example:

KM Partners

We share Personal Data necessary to fulfill orders with our Partners. The shared data is limited to the minimum information required to complete the order (name, mailing address, relevant contact information, ordered product details).

IT Service Providers

We have entered into contracts with several service providers to assist us in providing, operating, and maintaining our IT systems, including the KM websites. These service providers include hardware and software vendors, Google Inc. (which provides web analytics services Google Analytics), hosting service providers, or data centers, etc. When these service providers work for us, they may access your Personal Data as data recipients. However, these service providers are obligated to comply with applicable data protection laws pursuant to the contract.

Other Third Parties

We may share or disclose your Personal Data if we, in our sole judgment, believe that we are required to do so under applicable laws or regulatory requirements, or if we reasonably believe that disclosure is necessary to prevent harm or economic loss, or is related to the prevention of fraud or illegal activities, and/or to enforce our terms and conditions.

Parties to a Business Transaction

We reserve the right to transfer any information we collect in the event of a sale or transfer of all or part of our business or assets (including company shares) or any part or combination of products, services, businesses, and/or assets. 7. Data Protection and Security

Data Retention

After the termination or deactivation of your user account, KM may retain your data for a reasonable business period for record-keeping, auditing, or other purposes. Any Personal Data that we can access will be retained, stored, and deleted in accordance with our agreements with business partners and service providers.

Data Storage and Transmission

Your information will be stored and processed in the United States. If you are located in the European Union or other regions where data collection and use laws may differ from those in the United States, please note that we will take all reasonable and necessary measures to ensure that all Personal Data is processed securely and in compliance with this Privacy Policy.

Protecting Information Security

KM attaches great importance to the security of your information and has adopted commercially reasonable physical, technical, and organizational measures designed to maintain the integrity and security of all information we collect. However, no security system is absolutely secure, and we cannot guarantee 100% the security of our systems. If any information under our control is disclosed due to a security breach, we will take reasonable measures to investigate the situation and, if appropriate, notify the individuals whose information may have been disclosed in accordance with applicable laws and regulations, and take other actions.

8. Your Rights

Depending on the laws of your place of residence, you may have certain rights related to your information. For example, under local laws, you may request that we:

  • Update or correct your information

  • Restrict the use of your information

We will respond within the time limit specified by applicable law. Please note that many of the above rights are subject to exceptions and limitations. 9. California Residents

KM does not sell any Personal Data. To the extent required by California law, KM will disclose, delete, or take any other action with respect to any Personal Data of California residents. California residents may submit requests to KM pursuant to California law ("California Requests"), which include requests that KM:
  • Disclose to such residents:
    • The categories of Personal Data collected by KM;
    • The categories of sources from which KM collects Personal Data;
    • The purposes for which KM collects Personal Data;
    • The categories of third parties to whom KM transfers Personal Data;
    • The specific Personal Data collected by KM;
    • If Personal Data is sold or disclosed to third parties for commercial purposes, the categories of Personal Data sold or disclosed for commercial purposes and the categories of third parties to whom such Personal Data is sold or disclosed for commercial purposes;
  • Delete such residents' Personal Data, except in specific circumstances.

Any California Request submitted by a California resident

  • May only be made twice within a 12-month period.
  • KM is required to collect certain information to verify the resident's identity.
You may submit a request to KM by sending an email to support@komilight.com. We will respond within 45 days of receiving the request.
California law requires certain additional information disclosures. KM will not discriminate against any California resident for exercising any rights granted to them by California law.

10. Forms and Account Registration

By contacting us through a form, you agree that we may process the information you provide, including contact details, for the purpose of the form you submitted and to contact you. You may also use a pseudonym (or fictional name) as your name.

We will only process the data you submit through the form to provide you with the requested content, process your inquiry, and contact you. As long as we receive the contact details you provided through the contact form, we will not use such Personal Data for any other purposes other than the aforementioned purposes. We will not disclose your contact details to any third parties except as required by law.

11. Online Applications

By contacting us through our contact form to submit an application, you agree that we may process your contact details and application data (including any resume/CV you may send) to process your application and contact you.

We will only process the contact details and application information you submit through the application contact form to process your application and respond to you. As long as we receive the contact details and application information you provided in the application, we will only use them to process, contact, and respond to your application, and will not use such Personal Data for any other purposes. We will not disclose your contact details and application information to any third parties except as required by law.

If your application does not ultimately result in the establishment of an employment relationship with us, you may withdraw your consent to the future processing of your data at any time. After withdrawing consent, your contact details and application data will continue to be retained until we are required to retain them pursuant to legal retention obligations, or we still need your Personal Data to perform or process an existing contractual relationship, or for evidentiary purposes.

12. Use of Google Analytics

Google Analytics analyzes traffic data of the KM websites and collects various data about you and your user behavior on the KM websites (e.g., the web browser you use, your place of origin, your language settings, the search engine you use, the date and time of your visit to the KM websites, the time you spend on each page). Your IP address is collected only in an anonymous manner. We use Google Analytics to track user behavior on the KM websites and better understand such behavior, so that we can optimize the websites and provide users with higher quality services.

The KM websites use the functions of the web analytics service Google Analytics. The provider of this service is Google Inc. Google Analytics uses so-called "cookies". Cookies are text files stored on your computer to analyze your use of the KM websites. The information generated by the cookies about your use of the KM websites is usually transmitted to and stored by Google servers located in the United States.

You can refuse the use of cookies by selecting the appropriate settings in your browser, but please note that if you do so, you may not be able to use all the functions of the KM websites. You can also prevent Google from collecting the data generated by the cookies related to your use of the KM websites (including your IP address) and from processing this data by downloading and installing the available browser plugin.

13. Use of Embedded Social Media Sharing Buttons

We use embedded social media sharing buttons on the KM websites, and we display social media buttons of the following social networks on the KM websites:

A connection is established when a new window opens in your browser and loads the social network page where you want to share our blog or event posts. This window no longer belongs to our KM websites but is provided by the operator of the social network where you want to share the content. In the aforementioned new browser window, you will be asked to log in using your social network user account. After logging in, you can share the content of our KM websites with just one click. By clicking these buttons, you as a user agree to the transmission of data to the corresponding social network operator.

If you click the corresponding social media sharing button after activation, your Personal Data will be automatically transmitted to and stored on the servers of the corresponding social network operator, i.e., the corresponding service provider located in the United States. We have no control over the data collection and data processing processes, nor do we know the full scope, purpose, and storage period of data collection. You can identify the operator of the social network by the corresponding logo. To the best of our knowledge, social network operators typically store this data as user profiles and use it for advertising, market research, or website demand-oriented design. Such analysis is particularly used to display personalized advertisements and inform other users of the social network about your activities on the KM websites; even users who are not logged in to the corresponding social network will be affected. You can prevent social networks from associating your membership information on the social network with the information about you collected through the embedded social media sharing buttons on the KM websites by not activating the social media sharing buttons on the KM websites after logging in to the social network, but logging out of the social network in advance.

In addition to Google Analytics, KM may use internal and/or other third-party tools to analyze traffic data of the KM websites and collect various data about you and your user behavior on the KM websites. Similar to Google Analytics outlined in Section 11, we may collect information such as the web browser you use, your place of origin, your language settings, the search engine you use, the date and time of your visit to the KM websites, and the time you spend on each page. The purpose of using these tools is to track user behavior on the KM websites and better understand such behavior, so that we can optimize the websites and provide users with higher quality services.

Analytical tools use cookies to track your behavior on our websites. You can refuse the use of cookies by selecting the appropriate settings in your browser, but please note that if you do so, you may not be able to use all the functions of the KM websites.

15. Use of Marketing Services

KM uses inbound marketing services for remarketing/retargeting advertising to help us better provide customers with more appropriate and relevant content and advertisements. We have a legitimate interest in responding to your needs and ensuring and improving your user experience when interacting with KM.

We will use any of your information (including Personal Data) to provide services, such as displaying advertisements that may be of interest to you, including advertising and marketing to you, such as sending promotional information, displaying targeted advertisements, and showing you relevant offers based on the information you provide or our previous transaction records.

Remarketing refers to placing a cookie on your computer when you browse our websites, so that when you visit other websites, we can display advertisements for our products or services to you. We may from time to time use third-party service providers to provide remarketing services.

16. Payments

We may offer paid products and/or services in our services. In such cases, we will use third-party services for payment processing (e.g., payment processors).

We do not store or collect your payment card information. This information will be provided directly to our third-party payment processors, whose use of your personal information is governed by their privacy policies. These payment processors all comply with the Payment Card Industry Data Security Standard (PCI-DSS), which is managed by the Payment Card Industry Security Standards Council (PCI SSC), an organization jointly established by brands such as Visa, Mastercard, American Express, and Discover. PCI DSS requirements help ensure the secure processing of payment information.

17. Information Technology Security

We adopt a variety of technical and organizational security measures to protect the integrity and confidentiality of your Personal Data. To this end, your Personal Data will be encrypted using Secure Sockets Layer (SSL) technology during transmission. This means that the communication between your computer and the KM website servers uses a currently recognized secure encryption method. If your browser supports SSL, this feature can protect the transmission of Personal Data. This website is not intended for children under the age of 13. However, if a parent or guardian of a child under the age of 13 discovers that their child's Personal Data has been submitted to KM through this website without their consent, KM will, upon the request of the parent or guardian, take commercially reasonable measures to delete such information from this website and KM's servers. To request the deletion of such Personal Data, the parent or guardian must contact KM in the manner described in Section 19 and provide all information required by KM to identify the Personal Data to be deleted.
